WHERE’S MASCOT!? – Terms and Conditions
Effective Date: [September 30th, 2026]
These Terms and Conditions (“Terms”) govern your purchase of tickets and participation in any scavenger hunt (“Hunt”) operated by WHERE’S MASCOT!? (“we,” “us,” or “our”). By purchasing a ticket, creating an account, or participating in any Hunt, you agree to be bound by these Terms.
Eligibility
You must be at least 18 years old to purchase a ticket or participate.
Anyone may participate; however, every Hunt begins in the Gainesville, Florida area. You must be able to travel to the starting point and subsequent public waypoints.
One individual ticket per person.
We reserve the right to exclude employees, contractors, and immediate family members of WHERE’S MASCOT!? at our sole discretion.
Tickets and Pricing
Individual tickets are available as:
Weekly subscription: $14 per week
Monthly subscription: $49 per month
Both options provide the same competitive rights for the duration of the active subscription.
Group Ticket: $39. A Group Ticket counts as three individual entries, may occupy up to three leaderboard spots, and is eligible for up to three prizes. All members of a group are treated as a single participating unit unless a Group Ticket has been purchased.
All sales are final. No refunds will be issued for any reason, including but not limited to unused subscription time, inability to participate, change of mind, or dissatisfaction with the Hunt.
How the Hunt Works
After purchasing a ticket and creating an account, the first clue is delivered in your account/app.
Each clue directs you to a public location. At that location you will find a pink-and-green QR code. Scanning the QR code reveals the next clue.
Each Hunt contains between 6 and 12 clues.
Once you discover a clue, it remains accessible in your account.
Optional additional clues may be purchased. These additional clues use different wording but are not more helpful than the free clue path and provide no competitive advantage.
Winning and Ranking
Ranking is determined solely by the order of valid photo submissions.
The first valid submission of the mascot wins 1st place, the second valid submission wins 2nd place, and so on through 10th place.
A valid submission is a clear photo of the mascot that includes the LCD screen on the box showing the current code. The LCD code changes every minute, and the screen color is unique to each Hunt.
The Hunt ends when 10 valid winners have been verified.
The same person may participate in multiple Hunts and may win more than once across different Hunts.
Groups
If multiple people search together and submit the same or substantially similar photos (same LCD code, same approximate timestamp, etc.), we will treat them as a single group.
A group is eligible for only one prize unless a Group Ticket was purchased.
We will contact the submitters and award only one prize to the group. Our determination of whether submissions constitute group play is final.
Prizes
Prize structure for each Hunt:
1st Place: MacBook Neo (approximate retail value $699)
2nd Place: iPad (approximate retail value $449)
3rd Place: Apple Watch (approximate retail value $399)
4th Place: $250 cash
5th Place: $150 cash
6th–10th Place: $100 cash each
Winners are solely responsible for any and all applicable taxes on prizes. We may issue a Form 1099 if required by law. Consult your own tax advisor.
We will attempt to contact winners by text message and/or email. Prizes will be personally delivered when possible. Photos may be taken for Instagram, our Hall of Fame, and other promotional use.
If a winner cannot be reached after persistent contact attempts for two (2) weeks, the prize will be forfeited and may be awarded through a separate free sweepstakes giveaway at our sole discretion.
Verification, Cheating, and Disputes
The LCD screen changes every minute and uses a unique color for each Hunt to help deter cheating.
We reserve the right to disqualify any participant, refuse a submission, or revoke a prize for suspected cheating, manipulated or fake photos, multiple accounts, unauthorized answer sharing, trespassing, or any other conduct we determine is unfair, unsafe, or harmful to the Hunt or other participants.
All decisions by WHERE’S MASCOT!? regarding the validity of submissions, ranking, disqualification, and prize awards are final and binding.
Safety, Locations, and Assumption of Risk
All clues and the mascot will be placed only in public locations.
You must not trespass on private property or enter any restricted, unsafe, or closed area.
Participation is entirely at your own risk. You are solely responsible for your own safety and the safety of anyone accompanying you.
WHERE’S MASCOT!? is not liable for any injury, loss, damage, death, or expense of any kind arising from your participation in the Hunt, including but not limited to traffic incidents, weather, terrain, or interactions with third parties.
You agree to obey all applicable laws and to respect public and private property at all times.
Cancellation and Modification
We reserve the right to cancel, postpone, modify, suspend, or terminate any Hunt at any time for any reason, including technical problems, safety concerns, legal issues, or force majeure. In the event of cancellation or modification, we have no obligation to issue refunds or alternative compensation.
Publicity and Content License
By submitting a photo or participating in any Hunt, you grant WHERE’S MASCOT!? a worldwide, royalty-free, perpetual, irrevocable license to use your name, likeness, submitted photographs, and any related content for marketing, social media (including Instagram), Hall of Fame, advertising, and any other promotional purposes without further notice, approval, or compensation.
Limitation of Liability and Indemnification
To the maximum extent permitted by law, WHERE’S MASCOT!? and its owners, officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to the Hunt or these Terms.
You agree to indemnify, defend, and hold harmless WHERE’S MASCOT!? from and against any and all claims, damages, losses, costs, and expenses (including reasonable attorneys’ fees) arising out of your participation, your violation of these Terms, or your violation of any law or the rights of any third party.
Binding Arbitration and Class Action Waiver
Please read this section carefully. It affects your legal rights.
Any dispute, claim, or controversy arising out of or relating to these Terms, your ticket purchase, the Hunt, or any prize (collectively, “Disputes”) shall be resolved exclusively by final and binding arbitration administered by the American Arbitration Association (“AAA”) in accordance with its Consumer Arbitration Rules (or Commercial Arbitration Rules if the Consumer Rules do not apply).
The arbitration will be conducted by a single arbitrator.
The arbitration will take place in Alachua County, Florida, or another location mutually agreed upon. Arbitration may also be conducted by telephone or video conference if preferred.
The arbitrator’s decision is final and binding. Judgment on the award may be entered in any court of competent jurisdiction.
Each party will bear its own costs and attorneys’ fees unless the arbitrator orders otherwise under applicable law or AAA rules.
We will pay any AAA filing or arbitrator fees that you would not have had to pay if you had filed the claim in court, to the extent required by the AAA rules or law.
Class Action Waiver
You and WHERE’S MASCOT!? agree that each may bring claims against the other only in an individual capacity and not as a plaintiff or class member in any purported class, collective, consolidated, or representative proceeding. The arbitrator may not consolidate claims of more than one person or preside over any form of class or representative proceeding.
Exceptions
Either party may seek temporary or preliminary injunctive or other equitable relief in a court of competent jurisdiction to protect intellectual property rights, enforce anti-cheating or safety provisions, or prevent irreparable harm, pending the outcome of arbitration.
Opt-Out
You may opt out of this arbitration agreement by sending written notice to support@wheresmascot.com within thirty (30) days of first accepting these Terms. The notice must include your full name, address, the email associated with your account, and a clear statement that you wish to opt out of arbitration. If you opt out, Disputes will be resolved exclusively in the state or federal courts located in Alachua County, Florida.
Governing Law
These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles. Subject to the Binding Arbitration section above, any court proceedings shall take place exclusively in the state or federal courts located in Alachua County, Florida.
